Terms and Conditions – Nudes London

Article 1 - Definitions

For the purposes of these terms and conditions:

  • Withdrawal period: The period within which the consumer may exercise their right of withdrawal.
  • Consumer: A natural person who is not acting in a professional or commercial capacity and who enters into a distance contractual relationship with the trader.
  • Day: A calendar day.
  • Long-term transaction: A distance contract relating to a series of products and/or services, with obligations spread over time.
  • Durable medium: Any medium that enables the consumer or the trader to store information in a way that allows future reference and unchanged reproduction of the stored information.
  • Trader: A natural or legal person offering products and/or services to consumers at a distance.
  • Distance contract: A contract concluded without the consumer and trader being simultaneously present, using one or more means of distance communication.
  • Means of distance communication: Any means used to conclude a contract without the consumer and trader being present in the same place.
  • General conditions: These general terms and conditions of the trader.

Article 3 - Applicability

These general terms and conditions apply to every offer made by Nudes London and any distance contract concluded between the trader and the consumer.

Before a contract is finalized, these terms and conditions will be made available to the consumer. If the contract is concluded electronically, the consumer can store and access them on a durable medium.

If there is a conflict between these general terms and specific product or service conditions, the most favorable conditions for the consumer will apply.

Article 4 - The Offer

  • If an offer is time-limited or subject to conditions, this will be clearly stated.
  • The offer contains a complete and accurate description of the products and/or services.
  • Any images used are a true representation of the products or services.
  • Obvious mistakes or errors in pricing or descriptions do not bind the trader.

Article 5 - The Contract

The contract is concluded when the consumer accepts the offer and meets the specified conditions.

  • If the contract is accepted electronically, the trader will immediately confirm receipt of the acceptance.
  • If no confirmation is received, the consumer may cancel the contract.
  • Nudes London ensures a secure web environment for electronic transactions.

Article 6 - Right of Withdrawal

Consumers have the right to withdraw from the contract within 30 days without providing a reason.

  • The withdrawal period begins the day after receiving the product.
  • The product may only be unpacked to assess whether the consumer wishes to keep it.
  • Withdrawal must be communicated in writing within 30 days.
  • The product must be returned in its original condition and packaging.
  • The consumer is responsible for return shipping costs.

Article 7 - Refunds

  • If the withdrawal is valid, Nudes London will process the refund as soon as possible, but no later than 30 days after receiving the product or proof of return.
  • The refund includes the original product price, but not the shipping costs unless the product was defective.

Article 8 - Exclusion of the Right of Withdrawal

Some products may be excluded from the right of withdrawal due to hygiene reasons or custom-made orders, if clearly stated in the offer.

Article 9 - Pricing

  • Prices will not be increased during the validity period of the offer, except in cases of tax rate changes.
  • Price increases after three months are only allowed if legally required or previously agreed upon.

Article 10 - Conformity and Warranty

  • Nudes London guarantees that the products comply with the contract, legal standards, and reasonable consumer expectations.
  • Any defects must be reported within 30 days of delivery.
  • Warranty coverage aligns with the manufacturer’s warranty and does not apply to:
    • Damage due to improper use
    • Unauthorized repairs or alterations

Article 11 - Delivery and Execution

  • Orders will be delivered to the address provided by the consumer.
  • Processing time is typically 1-3 business days.
  • Standard delivery within UK takes 8-12 business days.
  • If the order is delayed beyond 30 days, the consumer may cancel the contract at no cost.

Article 12 - Duration and Termination of Contracts

  • Consumers may terminate open-ended contracts with one month’s notice.
  • For fixed-term contracts, consumers can terminate at the renewal period with one month’s notice.

Article 13 - Payment

  • Consumers must complete payments within 14 days unless otherwise specified.
  • If payment is for services, the payment period begins upon receipt of the contract confirmation.
  • Discrepancies in payment details must be reported immediately.

Article 14 - Complaints Procedure

  • Complaints regarding the contract must be submitted within 14 days with a detailed explanation.
  • Nudes London will respond within 30 days.
  • If a complaint is justified, the trader may offer:
    • A replacement product
    • A repair solution
    • A partial or full refund

Article 15 - Disputes

  • Contracts between Nudes London and consumers are governed by UK consumer laws.
  • If disputes arise, efforts will be made to resolve them amicably.
  • If a resolution cannot be reached, disputes will be subject to the jurisdiction of UK courts.

By placing an order on nudeswears.com, the consumer acknowledges and agrees to these Terms & Conditions.
